Terms of Service

These Terms govern your access to and use of CHUD, which is operated by Hubert Phan and Khoi Tran.

By creating an account, signing in, uploading a meal, joining a group, or using CHUD, you agree to these Terms.

Eligibility

You must be at least 18 years old to create an account or use CHUD.

By creating an account or using CHUD, you confirm that you are at least 18 years old and have the legal capacity to agree to these Terms.

Entertainment only

CHUD is a photo-first food journal built for entertainment and personal meal-history features.

CHUD is not a health, nutrition, medical, allergy, food safety, weight-loss, mental health, or dietary advice service.

Do not rely on CHUD scores, metrics, summaries, reports, verdicts, roasts, or other outputs for health, safety, medical, nutritional, legal, or other professional decisions.

Meal photos, AI, and generated output

When you submit a meal photo or related context, CHUD may store it and process it with automated systems and third-party AI providers to identify visible food items, analyze meal evidence, generate CHUD metrics, produce summaries, create verdicts and roasts, prepare reports, support groups, and operate app history.

AI-generated and AI-assisted output may be wrong, incomplete, delayed, repetitive, unexpected, or based on limited visual evidence. CHUD does not guarantee that any score, metric, label, summary, verdict, roast, report, or other output will be accurate, appropriate, safe, or suitable for any particular user or situation.

CHUD outputs are for entertainment and product functionality. They are not factual determinations about a person and are not medical, nutritional, mental health, legal, food safety, allergy, weight-loss, or dietary advice.

You are responsible for reviewing CHUD output before sharing it, acting on it, or relying on it outside the app’s entertainment experience.

Your content

You are responsible for the meal photos, notes, Meal Sources, profile information, reactions, group activity, reports, and other content you submit to CHUD.

Only upload or share content that you have the right to upload or share. Do not upload private, sensitive, confidential, unlawful, infringing, or non-consensual content, including private or sensitive images of other people, without all necessary rights and permissions.

You keep ownership of your content.

You give CHUD a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, transform, display, create generated outputs from, share, and otherwise use your content as reasonably needed to operate, secure, support, moderate, enforce, improve, and provide CHUD, including the group features you choose to use.

CHUD will not use your meal photos in marketing materials without your separate permission.

CHUD may preserve content and related records when reasonably needed for legal compliance, safety, abuse prevention, dispute resolution, billing, account integrity, security, or enforcement.

Groups and shared activity

If you join or use a CHUD group, other group members may see meal posts, meal photos, profile information, reactions, witnessing activity, group activity, generated commentary, summaries, roundups, bulletin-style content, and related activity associated with that group.

Do not use groups to harass, bully, shame, threaten, impersonate, expose, target, or ridicule another person. Do not post another person’s private, sensitive, confidential, or unlawful content without permission.

You are responsible for the groups you join, the content you submit, and the way you interact with other users.

Acceptable use

The Safety Rules are the single current rule set for prohibited content, user responsibilities, group conduct, reporting, blocking, enforcement, suspensions, and appeals.

Reporting, blocking, and moderation

You may report content, users, group activity, or AI-generated commentary that you believe violates these Terms, is offensive, is unsafe, infringes rights, or is otherwise inappropriate. CHUD may provide in-app reporting tools and may also accept reports through support.

Group features may include tools to leave groups, remove members where permitted, block or restrict abusive users, or report objectionable content or conduct.

CHUD may review reports, reported content, related account activity, generated commentary, meal metadata, group activity, and supporting information when reasonably needed to investigate reports, enforce these Terms, protect users, operate the service, comply with law, or prevent abuse.

CHUD may remove content, hide generated commentary, restrict group features, remove users from groups, suspend accounts, terminate accounts, preserve evidence, or report serious abuse or unlawful activity when we believe it is appropriate.

CHUD does not guarantee that all objectionable content or generated commentary will be detected before it appears. Users are responsible for reporting inappropriate content and using available safety controls.

Account suspension and termination

CHUD may suspend, restrict, or terminate your account or access to features if we believe you violated these Terms, created risk for CHUD or others, misused the service, violated another person’s rights, or used CHUD in a way that may cause legal, security, safety, operational, or reputational harm.

You may stop using CHUD at any time. Account deletion and data deletion are handled as described in the Privacy Policy and in available account settings or support flows.

The current enforcement levels and appeal process are maintained in the Safety Rules.

Subscriptions and cancellation

Some CHUD features may require a paid subscription, usage allowance, app version, supported platform, or backend availability.

Pricing, plan features, limits, and availability may change as CHUD changes.

Paid features may be billed through Apple, Google, Stripe, or another payment provider depending on your purchase path and where that purchase path is permitted.

Billing, renewal, cancellation timing, refunds, and related payment terms may also be governed by the terms and policies of the platform or payment provider you used.

CHUD does not control third-party billing systems and cannot override their charges, renewal settings, refund decisions, or app-store policies.

Deleting the CHUD app may not cancel an active subscription. Manage iOS subscriptions through your Apple App Store account. Manage Android subscriptions through Google Play. Manage web or Stripe subscriptions through the applicable Stripe or web account flow. If you cannot access the app, email [email protected] for help with cancellation or account deletion.

Third-party services

CHUD may depend on third-party services, platforms, software, models, app stores, payment processors, analytics providers, hosting providers, and infrastructure providers. These services may have their own terms, policies, limitations, outages, and data practices.

CHUD is not responsible for third-party services that it does not control, but CHUD will use service providers as described in the Privacy Policy and as reasonably needed to operate the service.

Service limits

Do not misuse CHUD, interfere with the service, attempt unauthorized access, scrape the service, reverse engineer private systems, overload infrastructure, or use CHUD for unlawful purposes.

CHUD may apply rate limits, storage limits, subscription limits, upload limits, group limits, safety limits, moderation limits, or other technical or product limits.

Disclaimers

CHUD is provided “as is” and “as available.” To the maximum extent permitted by law, CHUD disclaims all warranties, whether express, implied, or statutory, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, security, uninterrupted operation, and error-free operation.

CHUD does not guarantee that AI-generated content, scores, metrics, analysis, labels, verdicts, roasts, reports, group summaries, or other outputs will be accurate, appropriate, safe, available, or suitable for any particular user or situation.

Limitation of liability

To the maximum extent permitted by law, CHUD, its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost data, lost profits, service interruption, emotional distress, reputational harm, loss of goodwill, or loss of opportunity, arising from or related to CHUD or these Terms.

To the maximum extent permitted by law, CHUD’s total liability for any claim related to CHUD or these Terms will not exceed the greater of $50 or the amount you paid CHUD in the 12 months before the claim.

Indemnity

You agree to defend, indemnify, and hold harmless CHUD and its operators, Hubert Phan and Khoi Tran, from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your content, your misuse of CHUD, your violation of these Terms, or your violation of someone else's rights.

Changes

We may update these Terms as CHUD changes.

If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms, updating the Last updated date, or sending an in-app or email notice when practical.

Updated Terms apply when posted unless we say otherwise. If you do not agree to the updated Terms, you must stop using CHUD. Continuing to use CHUD after updated Terms apply means you accept them.
